Terms of Service

1. Who we are

DonkeyCMS is a product of DonkeyByte SRL ("we", "us"). These Terms govern your purchase and use of DonkeyCMS licenses through donkeycms.com.

2. What you're buying

DonkeyCMS is self-hosted software delivered as a download, licensed under the terms of the tier you purchase (Free, Pro, Business, or Agency), as described on our Pricing page. A license permits installation and use on the number of sites and by the number of team members specified for your tier.

These Terms govern your purchase. Your use of the software itself — what each tier permits, what happens if a licence lapses, and what you may and may not do with the code — is governed by our End User Licence Agreement, which you accept when you install or use DonkeyCMS.

3. Immediate delivery and withdrawal of the right to cancel

Because DonkeyCMS is downloadable digital content, once you request immediate access to your license and download and acknowledge this at checkout, you lose your statutory 14-day right of withdrawal under EU Consumer Rights Directive 2011/83/EU, Article 16(m). You will be asked to confirm this explicitly, separately from accepting these Terms, before your purchase completes.

4. Refunds

Because of the withdrawal waiver above, we are not obligated to offer change-of-mind refunds once a license has been delivered. If DonkeyCMS genuinely does not function as described, contact us and we'll work to resolve it, consistent with your rights under EU Digital Content Directive 2019/770/EU.

5. Billing

Pro and Business plans are billed on a recurring monthly or yearly subscription. Agency is billed yearly or available as a one-time lifetime purchase. Prices are shown exclusive of VAT; the applicable rate is calculated at checkout based on your billing location. Payments are processed by Netopia Payments; we never receive or store your card details.

6. Acceptable use

You may install and use DonkeyCMS on the number of sites your license permits. You may not resell, sublicense, or redistribute the DonkeyCMS source code itself, except as explicitly permitted under an Agency license's white-label terms (see our EULA, once published).

7. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to active subscribers by email.
